1. Acceptance of Terms

By accessing or using LukaChat (the "Platform"), operated by LukaChat ("we", "us", "our"), you confirm that you are at least 18 years of age, have read these Terms of Service, and agree to be bound by them. If you do not agree, you must not use the Platform.

2. Eligibility

Use of the Platform is strictly limited to adults aged 18 and over. By accessing any part of the Platform you represent and warrant that:

• You are at least 18 years of age.
• You have the legal capacity to enter into a binding agreement.
• You are not located in a jurisdiction where such content is prohibited.
• You are not accessing the Platform on behalf of a minor.

3. Permitted Use

The Platform provides 1-on-1 live video chat services. You agree to use the Platform solely for lawful, personal, non-commercial purposes. You must not:

• Record, capture, or distribute any video or audio from sessions without the explicit consent of all participants.
• Harass, threaten, stalk, or intimidate any other user.
• Transmit or solicit illegal content of any kind.
• Attempt to circumvent any verification, security, or access control mechanism.
• Use automated tools, bots, or scripts to interact with the Platform.
• Impersonate any person or entity.
• Use the Platform to solicit commercial or financial transactions outside of authorised in-app channels.

4. Account and Access

Some features require account registration. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. Notify us immediately at the support address below if you suspect any unauthorised use.

We reserve the right to suspend or permanently ban any account at our sole discretion, without prior notice, if we determine that you have violated these Terms or our Community Guidelines.

5. Content Standards

All content transmitted through the Platform, including video, audio, text, and images, must comply with applicable law and our Community Guidelines. Zero tolerance applies to any content involving minors. Any such content will be immediately reported to the relevant authorities.

6. Intellectual Property

All Platform software, design elements, trademarks, and branding are the exclusive property of LukaChat or its licensors. You are granted a limited, non-exclusive, non-transferable licence to access and use the Platform for personal purposes only. You may not copy, modify, distribute, or create derivative works from any part of the Platform without our written consent.

7. Privacy

Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform you consent to the data practices described therein.

8. Payments and Subscriptions

Premium features are available on a subscription basis. All payment terms, cancellation rights, and refund conditions are described in the Billing Rules. All prices are inclusive of applicable taxes unless stated otherwise.

9. Disclaimers

The Platform is provided "as is" without warranty of any kind. We do not guarantee uninterrupted availability, freedom from errors, or that any particular match will be available. We expressly disclaim all warranties, express or implied, to the maximum extent permitted by law.

10. Limitation of Liability

To the fullest extent permitted by applicable law, LukaChat shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of, or inability to use, the Platform. Our total liability for any claim shall not exceed the amount you paid to us in the twelve months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless LukaChat and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of your use of the Platform, your violation of these Terms, or your violation of any rights of a third party.

12. Changes to Terms

We may update these Terms at any time. We will notify registered users of material changes by email or in-app notification. Your continued use of the Platform after such notice constitutes your acceptance of the revised Terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the European Union and the jurisdiction in which LukaChat is registered. Any disputes shall be resolved exclusively in the competent courts of that jurisdiction.
